Acceptance of Terms
By accessing or using Peek-a-Menu ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
Description of Service
Peek-a-Menu is a platform that allows restaurants and food businesses to create, manage, and share digital menus accessible via QR codes. The Service includes a web-based dashboard for menu management and public menu pages for end customers.
Account Registration
To create an account, you must:
- Be 18 years of age or older, or have parental consent
- Provide accurate and complete registration information
- Maintain one account per business entity
- Keep your login credentials secure and confidential
You are responsible for all activity that occurs under your account.
Acceptable Use
You agree not to use the Service to:
- Upload, post, or display illegal content
- Upload, post, or display content that is offensive, harmful, or hateful
- Infringe upon copyright, trademark, or other intellectual property rights
- Distribute spam, malware, or malicious code
- Attempt to gain unauthorized access to the Service or other users' accounts
- Use the Service in a way that disrupts or degrades service for others
Payment and Billing
Free Tier
The Free plan includes 1 branch and up to 30 menu items at no cost.
Pro Tier
The Pro plan is available at $12.99 per month or $129 per year (billed annually). Pro includes unlimited branches, unlimited items, all themes, advanced analytics, and no platform branding.
Automatic Renewal
Subscriptions automatically renew at the end of each billing period unless canceled. You may cancel at any time, and cancellation takes effect at the end of the current billing period.
Refunds
We do not provide refunds for partial months or unused time. If you cancel, you retain access to Pro features until the end of your current billing period.
Price Changes
We will notify you of any price changes at least 30 days in advance. Continued use after a price change constitutes acceptance of the new pricing.
Intellectual Property
Your content: You retain ownership of all menu content, images, and materials you upload to the Service. You grant us a limited, non-exclusive license to display and distribute your content solely as necessary to provide the Service.
Our platform: Peek-a-Menu owns all rights to the platform itself, including its code, design, themes, branding, and user interface. You may not copy, modify, or reverse-engineer the platform.
Service Availability
We strive for a 99.9% uptime target but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance whenever possible. We reserve the right to suspend access for emergency maintenance, security incidents, or violations of these terms.
Limitation of Liability
The Service is provided "as is" without warranties of any kind, express or implied. Peek-a-Menu is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.
Our maximum liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.
Termination
By you: You may delete your account at any time from your account settings or by contacting us. All your data will be permanently deleted within 30 days.
By us: We may terminate or suspend your account for violations of these terms. For policy violations that can be remedied, we will provide 30 days notice and an opportunity to correct the issue. For serious violations (illegal activity, abuse, security threats), we may terminate immediately.
Dispute Resolution
These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any dispute arising from these terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
You agree to resolve disputes on an individual basis and waive any right to participate in a class action or representative proceeding.
Changes to Terms
We may modify these terms at any time. Material changes will be communicated via email or in-app notice at least 30 days before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
